Accurate Home Care has been forced to adopt new policies and procedures as a result MN Legislative Changes.
A letter has been sent to your home outlining the changes.

PCA Program Rule Changes
Purpose: To communicate changes that MN Legislation passed on June 18, 2009 that a Personal Care Assistant (PCA) must now abide by the new rules outlined in MN Statutes 2008, section 256, and all new MN Department of Human Services and MN Department of Health rules and regulations.
Statewide Policy Changes Effective as of:
- 7/1/2009, PCAs are only allowed to work 275 hours a month regardless of the number of companies or clients they work for under the capacity of a PCA. This means if you complete your own schedule, it is even more critical that you provide this to us on a monthly basis to ensure that we are able to ensure that all employees with our company do not exceed the 275 hours in a month.
- 7/1/2009, PCAs under 18 years of age are only allowed to work for ONE company that provides PCA Services.
- 7/1/2009, Clients receiving a combination of PCA and Nursing services will be limited to 4 hours of PCA services per day if they have 24 hours of Nursing, unless they are on a waiver.
- 7/15/2009, PCAs are only allowed to work 16 hours a day regardless of the number of companies they work for.
- 1/1/2010, persons who do not qualify as a personal care assistant include parents and stepparents of minors, spouses, paid legal guardians, family foster care providers, except as otherwise allowed in section 256B.0625, subdivision 19a, or staff of a residential setting.
- 1/1/2010, all PCA clients will be required to have a Qualified Professional that oversees the employees and your care. This includes PCA Choice clients. Guidelines of the frequency of the visits are based on the type of service you receive, but vary from every 90 days to every 180 days. In addition, all new PCAs in your home must be seen and supervised by a Qualified Professional within the first 14 days of working in your home.
- 1/1/2010, Responsible parties who are parents of minors or guardians of minors or incapacitated persons may delegate the responsibility to another adult who is not the personal care assistant during a temporary absence of at least 24 hours but not more than six months.
- The person delegated as a responsible party must be able to meet the definition of the responsible party, except that the delegated responsible party is required to reside with the recipient only while serving as the responsibile party.
- The responsible party must ensure that the delegate performs the functions of the responsible party, is identified at the time of the assessment, and is listed on the personal care assistance care plan.
- The responsible party must communicate to the company about the need for a delegate responsible party, including the name of the delegated responsible party, dates the delegated responsible party will be living with the recipient, and contact numbers.
- 1/1/2010, PCA services may not be paid to anyone who is the paid guardian of the client.
